Returns and Right of Withdrawal
We want you to feel confident when purchasing art from Ewa Borin Gallery.
If you are a consumer and have a statutory right of withdrawal under applicable consumer law, you may withdraw from your online purchase within 14 days of receiving the artwork or, where an order contains multiple artworks delivered separately, within 14 days of receiving the last artwork in the order, without giving a reason.
Nothing in this policy limits any mandatory consumer rights that apply to your purchase.
To exercise your right of withdrawal, please use our Withdrawal Form. You may also contact Ewa Borin Gallery through our Contact Form if you need assistance with a return.
Once you have notified us, the artwork must be returned without undue delay and, where applicable law requires, no later than 14 days after you informed us of your decision to withdraw.
Cancellation Before Shipment
If your order has not yet been fulfilled or shipped, you may be able to cancel it before dispatch. Where available, cancellation may be requested through the electronic withdrawal function or by contacting Ewa Borin Gallery through our Contact Form.
Nothing in this section limits any statutory right of withdrawal or other mandatory consumer rights that may apply before or after delivery.
Before Returning an Artwork
Please do not return an artwork or arrange return transportation without first contacting Ewa Borin Gallery.
Original artworks are unique and may be fragile, valuable or too large to be returned safely by ordinary postal services. Depending on the size, value and destination of the artwork, professional packaging, insured transportation or specialist art handling may be required.
We will provide return instructions and the appropriate return address after receiving your return request.
Return Shipping Costs
Where permitted by applicable law, the customer is responsible for the direct cost of returning an artwork when exercising the right of withdrawal.
Because original artworks vary considerably in size, weight, value and destination, return transportation costs may vary significantly. Larger artworks may require professional packaging, collection and insured transportation and may therefore involve substantial return costs.
Where required by applicable consumer law, information about the estimated cost of returning an artwork that cannot normally be returned by post will be provided before purchase.
Please contact Ewa Borin Gallery before arranging any return shipment so that an appropriate and secure return method can be established.
Condition of Returned Artwork
Returned artworks must be handled with appropriate care and returned in a condition consistent with the customer's right to inspect the artwork.
Where reasonably possible, the original protective packaging and any accompanying materials should be retained and used for the return.
The customer may be responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and condition of the artwork, to the extent permitted by applicable law.
Please do not modify, frame, mount, stretch, remove from its stretcher frame, clean or otherwise alter an artwork that you intend to return.
Refunds
Once a valid withdrawal has been exercised, Ewa Borin Gallery will refund payments in accordance with applicable consumer law.
Where applicable, this includes the cost of the least expensive standard delivery method offered for the original purchase. Any additional cost resulting from the customer's choice of a more expensive or expedited delivery method does not have to be refunded where permitted by law.
Refunds will normally be made using the same payment method used for the original purchase, unless otherwise agreed.
For returned goods, Ewa Borin Gallery may, where permitted by law, withhold the refund until the artwork has been received back or until the customer provides evidence that it has been returned, whichever occurs first.
Damaged or Faulty Artwork
Please inspect your artwork as soon as possible after delivery.
If an artwork arrives damaged, appears to have been damaged during transportation, or you believe that you have received an incorrect or faulty item, please contact Ewa Borin Gallery as soon as possible.
Please retain all original packaging and shipping materials and provide photographs of:
- the artwork and any damage;
- the external packaging;
- the internal protective packaging; and
- any visible damage to the shipping container or crate.
This information may be required in connection with a transport or insurance claim.
Please do not return a damaged artwork before receiving return instructions from Ewa Borin Gallery.
Where an artwork is faulty, damaged or otherwise subject to mandatory consumer protection rights, your statutory rights remain unaffected. Return transportation costs will be handled in accordance with applicable law.
Original and Unique Artworks
Many artworks sold by Ewa Borin Gallery are unique original works of art. Consequently, an identical replacement will normally not be possible if an original artwork is damaged or lost.
Where appropriate, Ewa Borin Gallery will work with the customer to find a suitable solution in accordance with applicable consumer law and any applicable transport insurance.
International Returns
International returns must always be arranged in consultation with Ewa Borin Gallery before the artwork is shipped.
Returns from outside the European Union may require specific customs documentation in order to identify the shipment correctly as returned goods and to avoid unnecessary customs charges.
Customers should not arrange an international return independently without first receiving instructions from Ewa Borin Gallery.
Customs Duties, Import Taxes and Other Charges
Orders delivered outside the European Union may be subject to customs duties, import VAT, taxes, brokerage fees or other charges imposed by the destination country or by third-party service providers.
The treatment of these charges depends on the destination, delivery terms and applicable customs regulations.
Where customs duties, import taxes or other charges have been paid directly by the customer to a customs authority, carrier or other third party, any potential reimbursement of those charges following a return is generally subject to the rules and procedures of the relevant authority or service provider.
Where Ewa Borin Gallery has paid such charges on behalf of the customer, their treatment in connection with a return will be determined in accordance with applicable law, customs procedures and the terms of the relevant carrier or service provider.
Please contact Ewa Borin Gallery before returning an internationally shipped artwork so that the appropriate customs procedure can be followed.
Exceptions
The statutory right of withdrawal may not apply to certain goods or transactions where an exception is provided by applicable law, including, where relevant, goods made to the consumer's specifications or clearly personalised.
Any such exception will only be applied where legally applicable and will not limit mandatory consumer rights.
